Nashville Nails Terms and Conditions
Effective date: September 16, 2025
These Terms and Conditions (the “Terms”) govern your access to and use of the Nashville Nails website, online booking, and related services (collectively, the “Site”). The Site is operated by Baggett & Phillips LLC dba Nashville Nails (“Nashville Nails,” “we,” “us,” or “our”). We are located at 1921 N Bronson Ave, Los Angeles, California 90068.
By accessing or using the Site, booking an appointment, purchasing products or gift cards, or otherwise interacting with Nashville Nails online, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility and Accounts
1.1 Eligibility. You must be at least 13 years old to use the Site. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
1.2 Account Security. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

2. Online Booking, Deposits, Cancellations, and Late Arrivals
2.1 Booking. Appointments may be booked through the Site or any third-party booking platform we use. You agree to review and comply with any additional terms posted in the booking flow. If our booking is provided by a third party, that provider’s terms will also apply.
2.2 Deposits and Holds. We require a card on file or a deposit for services totaling over $50. Deposits are applied to your service at check-out. If you miss or cancel outside our window, deposits will be forfeited as a reasonable estimate of our loss.
2.3 Cancellations and No-Shows. Please cancel or reschedule at least 24 hours before your appointment to avoid fees. Late cancellations and no-shows result in forfeiture of the deposit. Repeated no-shows may result in account restrictions.
2.4 Late Arrivals. If you are late, we will try to accommodate you. Your service may be shortened to avoid impact on other guests. If you arrive more than 10 minutes late, we may treat the appointment as a no-show and keep the deposit.
2.5 Service Adjustments. Service times are estimates. We may refuse or modify services for safety, hygiene, or professional judgment.

3. Pricing, Payments, Tips, and Taxes
3.1 Pricing. Prices displayed on the Site are subject to change without prior notice. The final price may vary based on your selections, add-ons, and technician recommendations.
3.2 Payment. We accept the payment methods shown at checkout. By submitting a payment method, you represent that you are authorized to use it and you authorize us to charge it for the amounts due, including applicable taxes and fees.
3.3 Gratuities. Tips are optional and go to your technician unless otherwise stated.
3.4 Chargebacks. If you dispute a valid charge, we may suspend your account until the dispute is resolved. Fraudulent chargebacks may be pursued.

4. Memberships, Packages, and Auto-Renewals (Future Offering)
4.1 Notice. Memberships and auto-renewals may be offered in the future. When available, Nashville Nails will disclose all key terms, pricing, renewal cadence, and cancellation methods at sign-up.
4.2 Authorization and Cancellation. By enrolling, you will authorize recurring charges until you cancel. A simple online cancellation method will be provided. Until then, memberships are not active.

5. Gift Cards and Credits
5.1 No Expiration or Fees Where Required by Law. Gift cards issued by Nashville Nails do not expire and are not subject to service fees, except where permitted by law. Balances of less than $10 may be redeemable for cash in California.
5.2 Non-Transferable. Lost or stolen cards will not be replaced except where required by law. Gift cards are not reloadable unless stated and cannot be redeemed for cash except where required by law.
5.3 Promotional Credits. Promotional vouchers or credits may have shorter redemption periods and special terms. Those terms will control to the extent permitted by law.

6. Health, Safety, Allergies, and Releases
6.1 Health Disclosure. Please disclose any allergies, skin sensitivities, medical conditions, or recent treatments that could affect service safety. We are not medical providers and our services are cosmetic only.
6.2 Allergy and Sensitivity Notice. Nail products may contain ingredients that can cause allergic reactions or sensitivities. Inform your technician before service if you have known allergies or sensitivities. Patch tests may be available upon request.
6.3 Illness and Contagious Conditions. For the safety of all guests and staff, we may decline or reschedule services if you are ill or present symptoms that pose a risk.
6.4 Minors. Guests under 18 must have a parent or legal guardian present or provide written consent as required by our policy.
6.5 Waiver and Assumption of Risk. By receiving services, you acknowledge inherent risks associated with cosmetic treatments and agree that, to the extent permitted by law, Nashville Nails and its owners, employees, and independent contractors are not liable for adverse reactions caused by undisclosed conditions, misuse of aftercare instructions, or failure to follow technician guidance.

7. Independent Professionals
7.1 Independent Contractor Notice. Some services may be provided by licensed independent professionals. They are responsible for the services they perform and for complying with all professional and licensing requirements. Nashville Nails provides facilities, scheduling, and support.
7.2 Quality and Concerns. If you have a concern about your service, contact us promptly so we can address it.

8. User Content, Reviews, and Photo/Video
8.1 User Content. If you post reviews, comments, or other content on the Site or our social channels, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for marketing and operational purposes, subject to applicable law and our Privacy Policy.
8.2 Before/After Images. We will only capture or use your image for marketing with your consent. You can withdraw consent at any time by emailing us. Withdrawal does not affect prior, already published uses.
8.3 Prohibited Conduct. Do not upload unlawful, defamatory, obscene, infringing, or harmful content. We may remove content at our discretion.

9. Intellectual Property
9.1 Ownership. The Site, including text, graphics, logos, and other content, is owned by Nashville Nails or our licensors and is protected by copyright, trademark, and other laws. All rights not expressly granted are reserved.
9.2 Limited License. We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, modify, reverse engineer, or create derivative works from the Site.
9.3 Trademarks. Nashville Nails and related marks are trademarks or service marks of Nashville Nails. Do not use our marks without prior written permission.

10.1 SMS Terms. If you opt in to receive SMS messages, you consent to receive texts about appointments, reminders, and marketing. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP. Reply HELP for help.
10.2 Email. If you provide your email, you consent to receive transactional and marketing emails. You can unsubscribe at any time using the unsubscribe link in our emails. We honor opt-out requests promptly.
10.3 Electronic Notices. You agree that we may provide notices electronically, including policy changes, receipts, and disclosures.

11. Product Sales, Shipping, and Returns
11.1 Availability. Products offered online are subject to availability. We may limit quantities.
11.2 Returns. For hygiene reasons, certain items may be final sale. If returns are offered, they will follow the posted policy on the product or checkout page.
11.3 Shipping. Shipping timelines are estimates. Risk of loss transfers at delivery by the carrier unless otherwise required by law.

16. Limitation of Liability
To the fullest extent permitted by law, Nashville Nails and its owners, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to the Site or services. Our total liability for any claim will not exceed the amount you paid for the service or product giving rise to the claim in the 3 months before the event.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.

17. Indemnification

18. Dispute Resolution, Arbitration, and Class Action Waiver
18.1 Good Faith Resolution. Most issues can be resolved quickly. Please contact us first.
18.2 Arbitration Agreement. Any dispute or claim arising out of or relating to these Terms, the Site, or services will be resolved by binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association. The Federal Arbitration Act governs the interpretation and enforcement of this agreement. Either party may bring an individual claim in small claims court in Los Angeles County, California.
18.3 Class Action Waiver. Disputes will be arbitrated only on an individual basis. Class, consolidated, or representative actions are not permitted.
18.4 Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing us with the subject line “Arbitration Opt-Out” and your name and contact details. Opting out does not affect other Terms.
18.5 Fees. Arbitration fees will be allocated by the arbitrator consistent with the applicable rules. Each party pays its own attorneys’ fees unless the arbitrator awards them under applicable law.

19. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Subject to the arbitration provision, the exclusive venue for any permitted court action will be the state and federal courts located in Los Angeles County, California.

• Automatic Renewals. If you enroll in an auto-renewing plan, we will present key terms clearly at sign-up, obtain your affirmative consent, send renewal or conversion reminders where required, and provide a simple online cancellation method.
• Gift Cards. Our gift cards do not expire and carry no fees, except where law allows. In California, any remaining balance under \$10 may be redeemed for cash on request.
• Email and Text Marketing. We will obtain consent as required and provide simple opt-out methods. We honor opt-out requests promptly.
